While the universe of design-build case law remains small, particularly as compared to the frequency of litigation under other delivery systems, it is unrealistic to expect that design-build projects will be entirely free of conflicts. In such cases, it is important to understand the basis of the case law, and how court decisions serve to enhance future design-build relationships as well as help shape best practices.
