Description

This year marks the 100th anniversary of the landmark case of U.S. v. Spearin (1918), which gave rise to the “Spearin Doctrine” of implied warranties. Did you know that there are over 500 legal doctrines that shape our laws? This program will focus on a dozen of the more common legal “doctrines” and how those might come into play on a design-build project. Topics will include The Spearin Doctrine, The Economic Loss Doctrine, The Acceptance (or Accepted-Work) Doctrine, The Severin Doctrine, The Work-For-Hire Doctrine, The Cardinal-Change Doctrine, The Superior Knowledge Doctrine, The Doctrine of Contra Proferentem, The Impossibility-of-Performance Doctrine, The Doctrine of Promissory Estoppel and more.
