Description

This panel will explore the unique issues raised for design-build contractors when participating in a public-private partnership (P3) procurement. The discussion will draw upon recent P3 project procurements to identify opportunities for, and help contractors navigate challenges faced by, large, as well as mid-sized and smaller contractors at the level of the prime design-build contractor engaged by the P3 developer or at lower tiers of subcontracting.

Learning Objectives:

  • Identify the unique challenges and opportunities faced by design-build contractors in a typical P3 based on recent market practice so as to ensure attendees are informed participants in their next P3.
  • Help focus design-build contractors’ assessment of P3 procurement and document terms on truly high priority risk and pricing issues.

  • Refine design-build contractors’ approach to providing comments on P3 procurement documents and otherwise negotiating terms of their subcontracts in order to more effectively communicate to target audiences (i.e. the owner, the P3 developer, debt providers, Federal regulators).
